With the real estate market being what it is, more and more home buyers are purchasing homes that are located in subdivisions with a homeowner’s association with binding restrictive covenants. The majority of disputes involving homeowner’s associations involve the restrictive covenants, their reasonableness, and, consequently, their enforceability.
